LHC VS Medical Colleges Case

LAHORE High Court Chief Justice Sheikh Azmat Saeed on Monday again sought reply from Punjab government by December 9 on a writ petition challenging establishment of four unrecognised medical colleges in the province.

The government was already directed to file reply but it failed to comply with court directions. Justice Saeed observed that Punjab government had already sought a number of adjournments in the case but could not file reply.

Advocate Noshab A Khan filed the petition stating that the government of Punjab inaugurated four medical colleges without fulfilling basic requirements. He said it should have approved recognition of the Pakistan Medical and Dental Council (PMDC) for validation of medical qualifications.

He said the government opened these medical colleges in Sialkot, Gujranwala, Sahiwal and Dera Ghazi Khan. He said there was allocation of 100 seats in each college and admissions for the academic session 2010-2011 had already been completed. The government remained oblivious despite students’ genuine concerns over not seeking Pakistan Medical and Dental Council recognition, he said.


Advocate Noshab A Khan said that the government needed to seek PMDC recognition with retrospective effect in order to give validation to the qualifications awarded by the aforementioned medical colleges.



Advocate Noshab A Khan submitted that in thesecolleges the qualificationwould be invalid without recognition by the supreme governing body regulating the medial and dental education.

He said the Punjab government did not even bother to apply to the Pakistan Medical and Dental Council for recognition till date. As a matter of fact for seeking recognition by Pakistan Medical and Dental Council, the government should have fulfilled the eligibility criteria, including college building, qualified faculty, attached teaching hospital, fully equipped laboratory and library, but the newly openedcolleges lacked all these basic requirements.

Advocate Noshab A Khan said the precious academic year of the students was at stake and if the government was not stopped from this illegitimate activity, the students were bound to suffer grave and irreparable loss.

He said the Supreme Court in its judgment had categorically declared fake all the medical and dental colleges lacking Pakistan Medical and Dental Council recognition. He prayed to the court to declare the opening of these colleges as illegal and having no legal authority. He also prayed to the court to stay the functioning of the colleges till final disposal of the petition.

IT Consultant laughed petition to Lahore High Court

LAHORE The former IT consultant of all eight intermediate and secondary boards of Punjab, Dr Majid Naeem on Thursday moved a petition before Lahore High Court challenging his arrest by the National Accountability Bureau (NAB) on corruption charges. The petitioner stated that his arrest was illegal as it was made without a nod from the NAB chairman and requested that the subsequent physical remand awarded by an accountability court to NAB be declared as illegitimate.


The NAB had arrested Dr Naeem as a reference was filed against him on charges of misappropriating Rs 2,797,850 in Punjab University’s funds and misuse of authority during his tenureas Punjab University College of Information Technology principal. The court had already rejected his acquittal application in the case. Dr Naeem soon after his remand by the NAB court had moved an application for plea-bargain.Daily Times.

LHC dismissed identical petitions challenging the provision of an entry test

LAHORE:16 November: A division bench of the Lahore High Court (LHC), on Tuesday, dismissed identical petitions challenging the provision of an entry test for admission in medical colleges of Punjab. The bench held that the merit list had already been prepared and it will cause irreparable damage to the students if the lists were cancelled at this time.

However, it also observed that the Pakistan Medical and Dental Council (PMDC) and the University of Health Sciences (UHS) might review the present criteria for admission in medical tests. The bench comprising Justice Ch Shahid Saeed and Justice Malik Shahzad, after conclusion of arguments by both the parties on November 2, had reserved the verdict.

The petitioners included Muhammad Zubair, Maqsood Ahmed Qureshi, Shagufta Mubeen, Robina Iqbal, Javaid Iqbal and Muhammad Khurshid. The petitioners’ counsel, Muhammad Azhar Siddique, submitted that the only criterion for admission into medical colleges was now an entry test and the students’ two-year hard work in the Intermediate was not being considered as valid grounds for admission. He said that the UHS had introduced a new method this year, which gave 50 percent weightage to the entry test, 40 percent to FSc marks and 10 percent to matriculation marks. He submitted that 50 percent weightage was being given to the entry test (MCAT), which was a paper of two-and-half-hours based purely on objective questions rather than on subjective and practical questions. He said it was the constitutional responsibility of the state to provide equal facilities of education to every citizen.Daily Times.
